Payal Salsburg is Panelist for Mass Bar Program on Anti-SLAPP Statute

Payal Salsburg is a panelist for a program entitled, “Is the Massachusetts Anti-SLAPP Statute Working as Intended.” The program is run by the Massachusetts Bar Association, sponsored by the civil litigation and real estate law sections, and will take place on Tuesday, May 23rd from 4-6pm.

In this program, the panelists will address how to identify and analyze viable special motions to dismiss in the context of the current burden-shifting anti-SLAPP framework as well as whether, and under what circumstances, abuse of process claims may still be brought in light of the statute. The program is important for litigators so that they will be able to identify whether the anti-SLAPP statute applies to a given set of facts.

Payal Salsburg Honored at Pioneering Woman of Color Celebration by Women’s Bar Association

The Women’s Bar Association of Massachusetts and its Women of Color Committee selected partner Payal Salsburg as an honoree for the annual Pioneering Women of Color Celebration which takes place on June 7th.

The WBA recognizes Payal for her long record of service to the community, her deep commitment to empowering women of color in the legal community, and her dynamic mentorship of future attorneys of color. In honoring Payal, the WBA President remarks that Payal is “a leader in the field and amplify the mission of the WBA through her work.”

Payal is joined by fellow honoree, Aziz Ahmed, a professor of law at Boston University School of Law.

 

Payal Salsburg Quoted in Bloomberg Law Article Covering Anti-SLAPP Laws

Payal Salsburg was quoted in an article entitled, “Broken State Speech Shield Unites Courts, Lawmakers Seeking Fix” which was published by Bloomberg Law in April. The article covers a recent request by Massachusetts lawyers, judges and law makers for clarity on the application of a law that protects First Amendment rights. The article explains that Anti-SLAPP laws create a pathway for courts to quickly remove meritless lawsuits seeking to intimidate people exercising their First Amendment rights. Payal, a business litigator, comments on how people are using the law as opposed to how it was intended: “the law was meant to be used as a shield, but people are using it as a sword.”

Payal Salsburg Quoted in Mass Lawyers Weekly Article

Partner, Payal Salsburg, was recently quoted in an article entitled, “In family business dispute, appraisal right deemed waived” which was published in Massachusetts Lawyers Weekly’s April 7th issue.  According to the article, the case provides warns attorneys to be familiar with documents controlling the purchase of equity, especially when there are multiple integrated agreements.

Payal is quoted in connection with Judge Salinger’s decision, saying it is “a lesson on the best way to draft amendments to an agreement, said Payal Salsburg of Boston. If a contract provision has seven “sub-provisions” and only one is being changed, it still may be best to strike the provision in its entirety and then incorporate any language being retained into the new provision, she said. Failure to do so just creates unnecessary complications when it comes time to interpret the language.”

Payal Salsburg Elected Treasurer of the Women’s Bar Association

Congratulations to our partner, Payal Salsburg, upon being elected as Treasurer for the Women’s Bar Association’s Board of Directors. As a WBA Officer, she joins the executive board and will oversee financial matters affecting members of the organization.

Payal Salsburg Moderates Women’s Bar Association Program

Payal Salsburg is the moderator for an upcoming “Finding Your Voice in the Courtroom and Boardroom” program which is co-sponsored by Suffolk University Law School and the Women’s Bar Association In-House Counsel committee. The program takes place on Thursday, February 9th from 5-7pm at Suffolk Law. The panel features Honorable Denise Casper of the U.S. District Court, Honorable Debra Squires-Lee of the Superior Court as well attorneys practicing at law firms and an in house counsel. Matt Kane and Payal Salsburg Reappointed by the Board of Bar Overseers as Hearing Officers

Matt Kane and Payal Salsburg have each been reappointed as hearing officers by the Board of Bar Overseers for a second three-year term. Established by the Supreme Judicial Court as an independent administrative body to investigate and evaluate complaints against attorneys, BBO hearing officers preside in panels of three over disciplinary proceedings brought against individual attorneys by the Office of Bar Counsel. In this role, Matt and Payal hear evidence, make findings of fact, and, where appropriated, provide sanctions recommendations to the Board of Bar Overseers.

Payal Salsburg is quoted in a Massachusetts Lawyers Weekly article, “Snap Judgements: Local Lawyers Offer Issues to Watch for in 2023” on December 30th:

In the area of business litigation, courts across the commonwealth will continue to grapple with applying the anti-SLAPP statute to dismiss claims that may be based on petitioning activity. Given the number of cases in the Superior Court and the Appeals Court in 2022 that deal with this issue, the SJC may have to again clarify the correct application of the standard first set out in Duracraft Corp. v. Holmes Prods., Corp. (1998), and subsequently augmented by 447 Harrison Ave., LLC v. JACE Boston, LLC (2019), and Blanchard v. Steward Carney Hosp., Inc. (2019).”
