Payal Salsburg Quoted in Mass Lawyers Weekly Article

Partner, Payal Salsburg, was recently quoted in an article entitled, “In family business dispute, appraisal right deemed waived” which was published in Massachusetts Lawyers Weekly’s April 7th issue.  According to the article, the case provides warns attorneys to be familiar with documents controlling the purchase of equity, especially when there are multiple integrated agreements.

Payal is quoted in connection with Judge Salinger’s decision, saying it is “a lesson on the best way to draft amendments to an agreement, said Payal Salsburg of Boston. If a contract provision has seven “sub-provisions” and only one is being changed, it still may be best to strike the provision in its entirety and then incorporate any language being retained into the new provision, she said. Failure to do so just creates unnecessary complications when it comes time to interpret the language.”

Real Estate Brokers May Get A Commission Even Without A Written Contract

The Massachusetts Supreme Judicial Court recently ruled that a real estate broker could obtain damages stemming from a breach of contract of an oral agreement, even where the broker did not produce the final closing.

Payal Salsburg Elected Treasurer of the Women’s Bar Association

Congratulations to our partner, Payal Salsburg, upon being elected as Treasurer for the Women’s Bar Association’s Board of Directors. As a WBA Officer, she joins the executive board and will oversee financial matters affecting members of the organization.

Darshana Indira Named to the Massachusetts Bar Association Nominating Commitee

Payal Salsburg Moderates Women’s Bar Association Program

Payal Salsburg is the moderator for an upcoming “Finding Your Voice in the Courtroom and Boardroom” program which is co-sponsored by Suffolk University Law School and the Women’s Bar Association In-House Counsel committee. The program takes place on Thursday, February 9th from 5-7pm at Suffolk Law. The panel features Honorable Denise Casper of the U.S. District Court, Honorable Debra Squires-Lee of the Superior Court as well attorneys practicing at law firms and an in house counsel. The panelists will discuss their experience in the courtroom and the boardroom as junior and senior lawyers, and talk about the methods and strategies that worked for them to become successful practitioners. Darshana Indira Presents on Microaggressions in the Workplace

Darshana Indira is a panelist for the Massachusetts Bar Association’s program, “Microaggressions in the Workplace: Part 2” taking place on Thursday, February 9th from 5:30-7pm.  This virtual program is sponsored by the MBA’s Civil Rights & Social Justice Section and is part of the Bar’s Diversity, Equity and Inclusion Committee’s (DEIC) three-part training on how to develop and maintain a diverse network and workplace by creating safe, healthy and supportive spaces. No Double Dipping: Putting the Brakes on Acceleration Clauses in Commercial Leases

A term in a contract, even if clearly stated, does not guarantee that a court will enforce it when a dispute arises between the parties. A recent decision by the Appeals Court on the issue of rent acceleration clauses may substantially affect commercial landlords and tenants.

Matt Kane and Payal Salsburg Reappointed by the Board of Bar Overseers as Hearing Officers

Matt Kane and Payal Salsburg have each been reappointed as hearing officers by the Board of Bar Overseers for a second three-year term. Established by the Supreme Judicial Court as an independent administrative body to investigate and evaluate complaints against attorneys, BBO hearing officers preside in panels of three over disciplinary proceedings brought against individual attorneys by the Office of Bar Counsel. In this role, Matt and Payal hear evidence, make findings of fact, and, where appropriated, provide sanctions recommendations to the Board of Bar Overseers.

Darshana Indira Selected for Public Interest Leadership Program through the Boston Bar Association

The Boston Bar Association of Massachusetts selected Laredo & Smith Attorney Darshana Indira to participate in the Boston Bar Association’s 2023 Public Interest Leadership Program (PILP). This highly respected program welcomes a select group of talented and highly-motivated lawyers to participate in a year-long program providing intensive leadership and professional development training. Participants learn from and connect with leaders in Boston’s public and private sectors to gain the critical skills and tools needed to grow as an effective leader and voice in the community.

Darshana will participate in monthly training sessions incorporating education, discussions, debriefing sessions and activities. In addition to these modules, she will attend several programs, events and meetings with legislators, judges, non-profit executives, and corporate leaders throughout Boston.

 

Payal Salsburg quoted in Mass Lawyers Weekly on Issues to Watch for in Business Litigation in 2023

Payal Salsburg is quoted in a Massachusetts Lawyers Weekly article, “Snap Judgements: Local Lawyers Offer Issues to Watch for in 2023” on December 30th:

In the area of business litigation, courts across the commonwealth will continue to grapple with applying the anti-SLAPP statute to dismiss claims that may be based on petitioning activity. Given the number of cases in the Superior Court and the Appeals Court in 2022 that deal with this issue, the SJC may have to again clarify the correct application of the standard first set out in Duracraft Corp. v. Holmes Prods., Corp. (1998), and subsequently augmented by 447 Harrison Ave., LLC v. JACE Boston, LLC (2019), and Blanchard v. Steward Carney Hosp., Inc. (2019).”
