Payal Salsburg Named to South Asian Bar Association of Greater Boston Board of Directors

Payal Salsburg has been elected to serve on the 2020 Board of Directors for the South Asian Bar Association of Greater Boston (SABA GB). SABA GB is a local chapter of the South Asian Bar Association of North America (SABA NA), which is the umbrella organization for local SABA groups throughout the United States and Canada. Payal will support the organization’s mission to amplify the regional voice of South Asians in the legal profession. She will also help SABA GB to provide an ongoing forum for professional networking and development, legal scholarship and education, and advocacy and community involvement. Together, the Board of Directors promotes the advancement of attorneys and law students of South Asian heritage in the Greater Boston area and beyond.

Payal Salsburg Moderates BBA Panel

Payal Salsburg moderated a Boston Bar Association panel, “Representing Closely Held Businesses Post-Baker v. WilmerHale: A Delicate Dance” on January 7, 2019. The description provided by the Boston Bar Association reads:

In Baker v. WilmerHale, the Massachusetts Appeals Court permitted minority members of an LLC to sue outside counsel for breaching its fiduciary duty by orchestrating a “freeze out” in favor of the majority members. This brown bag program will focus on the delicate balance that outside counsel must maintain when confronted with power struggles between owners of a closely-held corporation:

  • Who is your client?
  • Do you owe fiduciary duties to third parties?
  • When the majority owners give you instructions, should you – or must you – disclose them to the minority?
  • Do you advise everyone to get separate counsel? Is it reasonable?

In this discussion, panels covered a range of pressing issues that have arisen in the wake of the Baker decision. The event was sponsored by the Business and Commercial Litigation sections, as well as the Ethics Committee.

Attorneys Kane and Salsburg Publish MassBar Article,”The Diminished Utility of Anti-SLAPP Motions”

Matthew Kane and Payal Salsburg co-authored a recent article for the Massachusetts Bar Association publication. The Civil Litigation Section Review is titled, “The Diminished Utility of Anti-SLAPP Motions.” In the article, they discuss the constitutional puzzle presented by the state’s anti-SLAPP statute.

Jessica Conklin Presents on BBA Career Panel

Jessica Conklin presented as a panelist for the Boston Bar Association program, “Career Focus: Transition between Government and Private Practice.”  The program, sponsored by the White-Collar Crime section, featured both private practice attorneys and members of the US Securities & Exchange Commission and the US Attorney’s Office. The panel discussed the transition between public and private practice as well as the benefits and drawbacks of such a shift.

Mark Smith Appointed to Court Management Advisory Board

We proudly announce that Mark Smith was recently appointed by the Supreme Judicial Court to the Court Management Advisory Board (CMAB)for a three-year term. Consisting of approximately a dozen members from diverse backgrounds in law, business and academia, the CMAB plays a critical role in guiding and supporting the Massachusetts Trial Court in its transformation to a system grounded in managerial best practices and data driven decision-making.
